By creating an account, installing our browser extension, downloading our mobile application, accessing our API, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must be at least 18 years of age to use the Service.

suss. is a scam detection and risk assessment platform. The Service analyzes text, images, URLs, and other content to generate risk scores, classifications, and educational guidance designed to help users identify potential scams and fraudulent activity.

Important: The Service provides informational risk assessments only. suss. does not provide legal, financial, investment, or law enforcement advice. Risk scores and classifications are probabilistic assessments and should not be relied upon as the sole basis for any decision.

We do not guarantee the accuracy, completeness, or reliability of any risk assessment. The absence of a warning does not mean content is safe, and the presence of a warning does not mean content is definitively fraudulent.

Certain features require an account. When you create an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your login credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts at our discretion, including for violations of these Terms.

You agree not to:

• Submit false, misleading, or fabricated scam reports
• Use the Service to harass, defame, or harm any person or organization
• Reverse engineer, decompile, or disassemble any part of the Service
• Circumvent security or access-control features
• Use the Service to develop a competing product
• Scrape or crawl the Service except through our published API
• Impersonate any person or entity
• Transmit viruses, malware, or other harmful code
• Abuse the feedback system to intentionally degrade model performance

The Service and its contents are owned by suss, Inc. and protected by intellectual property laws. This includes:

• All machine learning models, algorithms, and scoring systems
• Signal detection logic, heuristics, and classification rules
• Risk scores, assessments, and derived outputs
• Training data, aggregated datasets, and derived insights
• User interface designs, graphics, and branding

Nothing in these Terms grants you any right, title, or interest in our intellectual property, except the limited right to use the Service as permitted.

You retain ownership of content you submit (“User Content”). By submitting User Content, you grant suss a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and analyze such content for:

• Operating and providing the Service
• Improving and training machine learning models
• Developing derived insights, signals, and analytics
• Creating anonymized or aggregated datasets

You acknowledge that no compensation is owed for model training or improvements derived from User Content.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

suss disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Risk assessments will be accurate or complete
• The Service will detect all scams or fraudulent activity

You use the Service at your own risk and are solely responsible for decisions made based on information provided.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUSS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits, revenue, data, or business opportunities
• Financial losses from scams not detected by the Service
• Financial losses from false positive classifications
• Damages from reliance on risk assessments or scores

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SUSS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

You agree to defend, indemnify, and hold harmless suss, Inc. from claims arising out of your use of the Service, violation of these Terms, violation of third-party rights, or User Content you submit.

The Service integrates with third-party services including Trustpilot, ScamAdviser, WHOIS, Google Safe Browsing, Supabase, and Stripe. We do not control or assume responsibility for third-party services. Your interactions with them are governed by their respective terms.

The following terms apply to use of the suss. mobile application (“App”):

A. General

The App is licensed, not sold, to you. Your use is subject to these Terms and the usage rules of the applicable app marketplace.

B. Apple-Specific Terms

If you download the App from the Apple App Store:

• These Terms are between you and suss, Inc. only, not Apple Inc. (“Apple”). suss, not Apple, is solely responsible for the App and its content.
• Your license is limited to a non-transferable license to use the App on Apple-branded devices you own or control, per the Apple Media Services Terms of Service.
• suss, not Apple, is responsible for maintenance and support services. Apple has no obligation to furnish maintenance or support for the App.
• In the event of any failure to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• suss, not Apple, is responsible for addressing claims relating to the App, including product liability claims, regulatory compliance claims, and consumer protection claims.
• In the event of an intellectual property infringement claim, suss, not Apple, is solely responsible for investigation, defense, settlement, and discharge.
• You represent that you are not located in a U.S.-embargoed country and are not on any U.S. Government prohibited party list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the App and have the right to enforce these Terms against you.

C. Device Permissions

The App may request access to your camera, photo library, and push notifications. You may manage permissions through your device settings.

The suss. browser extension scans web page content, emails, and chat messages to provide real-time risk assessments. By installing the extension, you consent to this scanning. The extension may inject visual elements (badges, warnings, overlays) into web pages. These are provided by suss and are not part of the underlying website.

Portions of page content may be transmitted to our servers for analysis. See our Privacy Policy for details.

API access may require authentication credentials. You are responsible for maintaining confidentiality of API keys. You agree to abide by published rate limits and fair use policies. API responses are subject to the same disclaimers as the rest of the Service. You may not resell or redistribute API access without written consent.

We may terminate or suspend your access immediately, without prior notice, for any reason including breach of these Terms. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting info@gotsuss.com or using the account deletion feature in the app.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions. Disputes shall be resolved exclusively in Delaware state or federal courts.

Any cause of action must be commenced within one (1) year after it accrues.

We may modify these Terms at any time. If we make material changes, we will provide notice through the Service. Continued use after changes constitutes acceptance.

• Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and suss.
• Severability. If any provision is held invalid, the remaining provisions remain in effect.
• Waiver. Failure to enforce any provision is not a waiver of that provision.
• Assignment. You may not assign these Terms without our consent. We may assign without restriction.
• No Third-Party Beneficiaries. No third-party beneficiary rights are created, except as provided in the Mobile Application Terms regarding Apple.
